Terms of Service

1. Acceptance of Terms

By accessing or using Funkshun ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

Funkshun provides event discovery for attendees and event creation, management, and publishing tools for organizers, including support for multi-day schedules and activities.

Unless explicitly stated otherwise, Funkshun acts as a platform intermediary and is not the organizer or operator of listed events.

3. User Accounts

You agree to provide accurate information, keep account credentials secure, and remain responsible for activity under your account.

We may suspend or terminate accounts where needed for security, legal, or operational reasons.

4. Roles on the Platform

Public visitors: may browse publicly available event pages and event details without creating an account.

Organizers: may create and manage events, days, and activities, and are responsible for event accuracy, legality, and execution.

Collaborators: may be invited by organizers to help manage event content based on the access granted to them in the app.

5. Event Responsibility Disclaimer

Funkshun does not control event delivery, venue safety, or legal compliance for third-party events. Organizers are solely responsible for those obligations.

To the extent permitted by law, we are not liable for event cancellations, organizer misrepresentations, or damages arising from third-party event operations.

6. Ticketing and Payments

The current app does not process in-app card payments directly. If ticketing or payment features are introduced, payments may be handled by third-party processors and additional terms may apply.

7. Platform Fees

We may introduce paid features, service fees, or subscription plans in the future. Any applicable fees and effective dates will be communicated in advance.

8. Acceptable Use

You agree not to use the Platform for unlawful purposes, upload false or misleading event information, interfere with security or performance, or attempt unauthorized access, fraud, or abuse.

We may remove content or restrict accounts that violate these rules.

9. Content Ownership

You retain ownership of content you upload, including event details and media. You grant Funkshun a worldwide, non-exclusive, royalty-free license to host, display, distribute, and promote that content for operation of the Platform.

Platform technology, branding, and service systems remain the property of Funkshun and its licensors.

10. Data and Analytics Usage

We may collect and analyze usage data to operate, secure, and improve the Platform, and to create aggregated or de-identified insights.

Personal data is handled in line with our Privacy Policy.

11. Service Availability

We do not guarantee uninterrupted or error-free service. The Platform may be modified, updated, paused, or discontinued at any time.

12. Limitation of Liability

To the maximum extent permitted by law, Funkshun is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business.

Our total liability for claims relating to the Platform is limited to the amount you paid to Funkshun, if any, in the 12 months before the claim arose.

13. Indemnification

You agree to indemnify and hold Funkshun harmless from claims, liabilities, damages, and costs arising from your use of the Platform, your content or events, or your breach of these Terms.

14. Termination

We may suspend or terminate access if these Terms are violated or for legal, security, or operational reasons. You may stop using the Platform at any time.

15. Governing Law

These Terms are governed by the laws of Ireland. Any dispute relating to these Terms is subject to the jurisdiction of the Irish courts.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the Platform after updates become effective constitutes acceptance of the revised Terms.
